Terms of service

1. Scope
These Terms and Conditions (T&Cs) apply to all orders placed through the online store 'Roots and Soul' (hereinafter “Store”) by consumers (§ 13 BGB) and business customers (§ 14 BGB). Deviating conditions from the customer are not recognized unless we explicitly agree in writing.

3. Conclusion of Contract

  1. Product displays in the store are non-binding and do not constitute a legally binding offer but an invitation to order.

  2. By clicking the “Buy Now” button, the customer makes a binding offer.

  3. The contract is concluded when we accept the order by sending an order confirmation or by delivering the goods.

4. Prices and Payment

  1. All prices include statutory VAT and shipping costs.

  2. Payment methods available:

    • PayPal

    • Credit Card (Visa, Mastercard, etc.)

    • Instant Bank Transfer / Klarna

    • Shopify Payments (if activated)

  3. We reserve the right to exclude individual payment methods in individual cases.

5. Shipping / Delivery

  1. Delivery is made to the shipping address provided by the customer.

  2. Estimated delivery times are displayed on the product page. We will inform the customer immediately in case of delays.

  3. Shipping costs are displayed before the completion of the order.

  4. Risk passes to the customer upon delivery of the goods.

6. Right of Withdrawal / Cancellation Policy Right of Withdrawal:

Consumers have the right to withdraw from the contract within 14 days without giving any reason. The period begins upon receipt of the goods.

7. Warranty / Liability for Defects

  1. Statutory warranty rights apply.

  2. The customer must report obvious defects immediately upon receipt.

  3. In the case of justified defects, we will provide repair, replacement, or refund at our discretion.

8. Liability

  1. We are only liable for damages not inherent to the delivered goods in cases of intent or gross negligence.

  2. Liability under the Product Liability Act remains unaffected.

9. Data Protection / Privacy
Personal data is collected, processed, and used only for order processing and customer communication. For details, see our Privacy Policy.

10. Final Provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions remains unaffected.
